A federal district court judge in Binghamton has ruled against the city of Oneonta on a $98,000 lawsuit filed against the Federal Emergency Management Agency following the 1981 flooding of the city's wastewater treatment plant.
According to city attorney Albert Baldo, the court ruled that the FEMA flood insurance policy originally issued for the plant was void upon inception because federal regulations stipulate that a structure must be more than 50 percent above ground to be insured. The court found that more than 50 percent of the plant was not above ground, he said.
Baldo said that the city was awarded the $7,000 paid for the insurance premium.
The city filed an insurance claim in 1982 after a flood heavily damaged the wastewater treatment plant. After 11 months of investigation FEMA denied a claim for damages declaring the insurance policy invalid from its inception.
