Man faces criminal sale of controlled substance charge

COOPERSTOWN _ In Otsego County Court March 8 before Judge John Lambert, Calvin Carroll, 45, of New York City pleaded innocent at arraignment to two counts of third-degree criminal sale of a controlled substance, cocaine.

According to court records, the incidents occurred in the town of Oneonta on Oct. 31 and Dec. 5.

Carroll was jailed in lieu of $250,000 bail and is due back in court Monday.

Also in court March 8 before Judge Lambert:

"¢ James S. Hartley Jr., 26, of Ashland, was sentenced as a second-felony offender to 1 1/2-to-3 years in prison for fourth-degree grand larceny.

According to court records, the incident occurred April 7 in the town of Oneonta.

He was ordered to pay $2,329 in restitution and $375 in court fees.

"¢ Michael J. Marzocco Jr., 49, of New Berlin, was sentenced to five years probation for third-degree criminal possession of marijuana. He also was fined $1,000, assessed $375 in court fees and his driver's license was suspended for six months.

According to court records, the incident occurred Aug. 11 in Pittsfield.

In Otsego County Court March 5 before Judge Brian Burns, Christopher J. Callahan, 40, of Oneonta, was sentenced to 10 years in prison for first-degree rape.

According to court records, the incident occurred in the spring of 2007 in Laurens when he had contact with a girl who was younger than 13. An order of protection for the victim was issued.

Callahan also was sentenced to five years post-release supervision and assessed $1,370 in court fees.

Also in court March 5 before Judge Burns:

"¢ Bryden F. Miller, 40, of Otego, pleaded guilty to driving while intoxicated.

According to court records, the incident occurred Sept. 20 in the town of Oneonta.

He was released on his own recognizance and is scheduled to be sentenced May 7.

"¢ Kimberly Ewen-Dulak, 43, of West Palm Beach, pleaded guilty to driving while intoxicated and was sentenced to a one-year conditional discharge.

According to court records, the incident occurred Jan. 1, 1996 in the city of Oneonta.

She was fined $300 and assessed $90 in court fees.

In Otsego County Court March 3 before Judge Burns, Roy Young, 23, of Oneonta pleaded innocent at arraignment to third-degree criminal sale of a controlled substance.

Young is in jail in lieu of $10,000 bail. According to court records, the incident occurred Dec. 11 in the city of Oneonta.

In Otsego County Court Feb. 24 before Judge Burns, Walter Kleingardner, 53, of Otego pleaded guilty to DWI.

According to court records, the incident occurred Oct. 14 in Otego.

Also in court Feb. 24 before Judge Burns:

-John C. Cooper, 35, of Oneonta was sentenced to five years' probation for first-degree criminal contempt.

According to court records, the incident occurred Aug. 7 in the city of Oneonta.

Cooper was assessed $375 in court fees.

-Russell J. Kanser, 23, of New Berlin pleaded guilty to seventh-degree criminal possession of a controlled substance, heroin.

According to court records, the incident occurred in September in the city of Oneonta.

The charges against him were conditionally discharged and he was assessed $175 in court fees.
