DELHI _ A Walton man who admitted breaking probation by drinking five beers was sentenced to 2 1/3-to-7 years in jail in Delaware County Court on Monday.
Kenneth Barrows, 34, had been a member of the Delaware County Drug Court. He pleaded guilty to violating his probation for the second time in a matter of months.
Drug-court participants sign a contract in which they agree to be sentenced to the maximum sentence applicable if they don't comply with the conditions of probation.
Delaware County Judge Carl Becker told Barrows that he was "deeply disappointed that his life has taken this turn.
"I watched you participate, and I thought you were making progress, but it was little more than smoke and mirrors," Becker said.
Becker said he would make a recommendation that Barrows be assigned to the Shock program in prison. The intensive, six-month program of hard physical labor, academic education, drug treatment and personal counseling allows successful graduates to be released as much as 30 months early, according to a state website.
Barrows was convicted of DWI on Jan. 26, 2007. He admitted that he drank beer on March 12.
In another DWI-related case, Joseph Smith, 52, of Roxbury, was sentenced to two-to-six years under parole supervision through the Willard Program for violating his probation by drinking and driving.
Willard is a drug-treatment campus operated by the state Department of Correctional with the state Division of Parole and the state Office of Alcohol and Substance Abuse Services. It was created in 1995 as a sentencing option for low-level drug offenders and parole violators who previously would have been sent to a traditional prison.
Smith was sentenced to probation on a third-degree grand larceny conviction on Jan. 28, 2008. He was sentenced on a DWI charge in Roxbury Town Court.
In another DWI case, Dean R. More, 48, of Davenport Center, was arraigned on two DWI counts, consumption of alcohol in a vehicle and no seat belt.
More pleaded guilty to the charges that stemmed from an incident in Davenport on Jan. 16. He will be sentenced on Monday.
In other court business, Ernest Santiago, 33, no address available, was determined to be a Level 2 sex offender.
Santiago was convicted of rape on July 17, 2006, for having sex with a 15-year-old girl.
He is scheduled to be released from prison on July 4.
