Woman to get prison for burglary

Cases involving burglary, drugs and driving while intoxicated were heard in Delaware County Court on Monday.

A Fleischmanns woman pleaded guilty to burglarizing Jeffrey Bouton, 43, of Fleischmanns.

According to the terms of her plea agreement, Cheryl A. Scarth, 51, will be sentenced Feb. 17 to 21/2-to-5 years in prison. She entered her plea in satisfaction of outstanding charges associated with the burglary.

Scarth was originally arraigned on charges of second- and third-degree burglary, fourth- and fifth-degree conspiracy, second-degree criminal trespass and unlawful imprisonment. The charges stemmed from incidents on May 17 in Middletown.

Scarth is a second-felony offender who was sentenced to prison terms of one-to-three years and two-to-six years on convictions in 2000, Delaware County Judge Carl Becker said.

Delaware County Special Prosecutor Thomas Carr said she would have faced a minimum of seven years if she was found guilty of all the latest charges.

Scarth is also facing a first-degree charge of promoting prison contraband, that case being in Delhi Town Court. While in jail on the burglary charges, she was arrested June 11 for allegedly possessing a dangerous substance on June 5 in the Delaware County jail.

Scarth was also charged with tampering with physical evidence for allegedly trying to destroy the substance to prevent its use as evidence, Delaware County deputies said.

Carr said he is willing to have Scarth's sentence on the contraband charges run concurrently with her sentence on the burglary charge.

On Sept. 30, 2000, Scarth was one of 13 people charged with 57 counts of selling and possessing cocaine.

In other court cases:

ä Phillip K. Betton, 39, of Sidney, was sentenced to 51/2 years in prison with three years post-release supervision on a charge of third-degree criminal possession of a controlled substance for allegedly possessing 46 packets of heroin on July 21 in Sidney.

ä Walter J. Stedtler, 50, of Masonville, pleaded guilty to violating his probation and will be sentenced to one-to-three years in prison on Jan. 26.

Stedtler was on probation for a DWI charge from June 27, 2005.

He admitted being arrested for trespassing on Nov. 15, 2007, and for DWI on Sept. 23. He also has charges pending in Otsego County.

Stedtler is free on $2,500 bail.
