ONEONTA _ A man accused by city police of raping a college student Friday will appear in court next week.
Justin J. Gillingham, 23, faces a charge of first-degree rape. His court-appointed attorney is Jack Gibbons.
Gillingham, who appeared in court Tuesday, waived the time limit for a felony hearing, according to city court officials. No date for the hearing has been set, they said.
Gillingham allegedly attacked a 23-year-old State University College at Oneonta student on a well-worn path between the campus and Clinton Street.
The woman fought back against her attacker, according to police, city prosecutor Michael Getman and her statement to police on file in city court.
Gillingham is to appear May 27 for further proceedings, court officials said.
