Oneonta man pleads innocent to rape charge

COOPERSTOWN _ In Otsego County Court on Monday before Judge Michael Coccoma, Donald Moore, 43, of Oneonta, pleaded innocent at arraignment to a charge of third-degree rape.

According to court records, the incident occurred April 24 in the town of New Lisbon.

Moore posted $2,500 bail and is scheduled to return to court Jan. 14.

Also in court Monday:

ä Milton E. Brooks, 35, of Norwich, pleaded innocent at arraignment to two counts of third-degree rape. According to court records, the incidents occurred in October 2006 in the town of Edmeston.

Brooks was jailed in lieu of $2,500 bail and is scheduled to return to court Jan. 14.

ä Sandra Barse, 53, of Unadilla, was sentenced to one-to-three years in prison for third-degree grand larceny.

According to court records, the incident occurred between June 2005 and April 2006 in the town of Unadilla.

Barse, who pleaded guilty Oct. 5, was ordered to pay restitution of $89,543 to D.R. Chambers & Sons of Unadilla. She also was assessed a $270 surcharge and crime victims' fee and a $50 DNA fee.

In Otsego County Court on Nov. 30 before Judge Brian Burns, Billy Joe Effner, 26, of Worcester, was sentenced to 11/2 years in prison and two years post-release supervision for fifth-degree criminal sale of a controlled substance, dihydrocodeinone.

According to court records, the incident occurred in Worcester in January.

Effner was assessed a $270 surcharge and crime victims' fee, a $50 DNA fee and his driver's license was suspended for six months.

Also before Burns on Friday:

ä Christopher Devins, 25, of Oneonta, pleaded guilty to failure to register as a sex offender.

According to court records, the incident occurred Aug. 1 in the town of Middlefield.

Devins was jailed without bail to await sentencing on Jan. 18.

ä Rebekah E. Smith, 22, of Franklin, pleaded guilty to fifth-degree criminal sale of a controlled substance, heroin.

According to court records, the incident occurred Feb. 22, 2006, in the town of Oneonta.

Smith was sentenced to six months in jail, five years of probation, and she was assessed a $270 surcharge and crime victims' fee and a $50 DNA fee. In addition, her driver's license was suspended for six months.

ä Brian Gerke, 25, was sentenced to one year in jail for second-degree attempted assault.

According to court records, the incident occurred May 6 in the town of Middlefield. Gerke was assessed a $270 surcharge and crime victims' fee and a $50 DNA fee.

ä Brian Green, 22, of Oneonta, pleaded innocent at arraignment to a charge of first-degree sexual abuse.

According to court records, the incident occurred June 3 in the town of Laurens.

Green is free on $5,000 bail and is scheduled to return to court Jan. 4.
